Terms and Conditions

1. GENERAL

1.1. By installing the Alloo application, you agree to be bound by the terms of use. Please read the license agreements carefully before installation and/or acceptance.

2. DEFINITIONS

2.1. The “Application” shall mean the software provided by Alloo for the purpose of offering services related to mobile calling services, to be used on Android OS devices and Apple iOS, frequent upgrades along with any other software or documentation which enables the use of the Application.

2.2. Alloo is a service that allows users to make and receive calls while overseas.

3. DATA PROTECTION

3.1. Any sensitive credentials you provide to Alloo while using the Application, will be used by Alloo in acceptance with its Privacy Policy.

4. PROPRIETARY RIGHTS AND LICENCE

4.1. All trademarks, database rights, copyright and other intellectual property rights of any kind in the Application together with the original software code is owned directly by Alloo.

4.2. Alloo hereby grants you worldwide, royalty-free, revocable license to use the Application for your personal or business use in compliance with these app tenure.

5. CONDITIONS OF USE

5.1. You will not resort to and neither allow any third party on your behalf to (i) make and subsequently distribute copies of the Application (ii) attempt to copy, reproduce, alter, reverse engineer, modify, transfer or exchange the Application; or (iii) create slavish works of the Application of any kind at all.

5.2. Alloo reserves the right to change the rates at any time without any prior notice. In case you do not wish to accept such alternation of rates then you are entitled to close the account with effect from the date on which the alternation of rates would become effective. You confirm that by continuing to use the Alloo services, following the amendment of the rates, you accept such adjustments.

5.3. Accept the terms of agreement with your respective mobile network provider who will continue to apply when you use the Application. Subsequently, you might be charged by the mobile provider for use of network connection services for the period of the connection while using the Application or any such third party charges which might arise. You admit responsibility for any such charges that may come to pass.

5.4. If you are not the payer of the bill for the handheld device or mobile telephone being utilised to access the Application, you will be understood to have received consent from the bill payer for using the Application.

5.5. In case your device gets stolen or if you realise unauthorized use of the Alloo services you must at once alert us immediately to suspend the Alloo services. You are solely liable for all charges to your account with Alloo (“Account”) until the Alloo Services are stopped.

5.6. In order to buy credits for the Alloo service and to charge your Account, you shall pay Alloo the rates as stated on the website or in the Alloo App. Payments are made by you, unless stated otherwise.

5.7. All rates and charges shall be stated in USD.

5.8. Alloo services are for individual use only. Using the services for telemarketing or call centre operations, re-selling the subscription minutes, calling numbers (whether singly, sequentially or automatically) to generate income for yourself or others as a result of placing the call, will not be considered legitimate.

5.9. You will not resort to unusual calling patterns inconsistent with normal, individual subscription use, for example, regular calls of short duration or calls to multiple numbers in a short period of time.

5.10. In relation to the Alloo outcall packages, the following should be noted in particular. These packages offer outbound international calling services as set forth herein and on the website/App (note that third party charges may apply, see Section 5.3). You acknowledge and agree that the Alloo packages are intended only for normal, single-person and non-commercial use to regular landline and mobile numbers in certain applicable subscription countries (by way of example special, premium, service and non-geographic numbers are excluded).

6. EMERGENCY CALLS

6.1. The Alloo service is not aimed at supporting or making emergency calls to any type of law enforcement agencies, hospitals, medical care unit or emergency services of any kind and Alloo is not liable in any manner for such calls. In case another user uses your Account, with your permission, then you are responsible to inform the user that it is not possible to make any emergency calls with Alloo service.

7. AVAILABILITY

7.1. This Application is accessible on handheld mobile devices which run on Apple iOS or Android OS operating systems. Alloo will utilise all rational efforts to make the Application accessible at all times. However, please accept that the Application is provided over the internet & mobile networks, hence, the quality and availability of the Application is determined by factors outside Alloo reasonable control.

7.2. Alloo, its group of companies and sub-contractors do not admit or accept any liability whatsoever for unavailability of the Application. Alloo also does not take any responsibility for any complexity or incapability to either download or access content or any other communication system, failure of which may result in the Application being unavailable.

8. SYSTEM REQUIREMENTS

8.1. In order to utilise the Application, a compatible handheld device, access to internet and the necessary minimum specifications (‘Software Requirements’) are required.

8.2. The Software Requirements include: Apple iOS devices, Android OS devices.

8.3. The version of the Application software may be regularly upgraded to add support for new functions and services.

9. TERMINATION

9.1. Alloo may terminate use of the Application at any time by providing notice of termination.

9.2. Upon termination at any time, (a) all the rights and license granted to you herein shall end; (b) you must stop all use of the Software.

10. LIMITATION OF LIABILITY

10.1. Under no circumstance, will Alloo be accountable for any direct, indirect, special, punitive, exemplary or consequential losses or damages of whichever kind occurring out of your usage or access to the Application, including loss of profit or similar, whether or not in the contemplation of the parties, whether based on breach of contract, product liability or otherwise.

10.2. Alloo is not accountable to you for any damage or change to your equipment including but not limited to computer equipment, handheld device, owing to the installation or use of the Application.

10.3. Nothing in these App terms shall exclude or limit Alloo’s legal responsibility/accountability for death or personal injury caused by neglect or for deception or fraudulent misrepresentation or any other liability which cannot be excluded or limited under applicable law.

10.4. If you are living in a jurisdiction where it is forbidden by law to offer or use internet telephony or the Alloo services, you may not accept this Agreement.

11. DISCLAIMER OF WARRANTIES

11.1. Alloo does not make any express guarantee/warranty regarding the Alloo services and disclaim any implied warranty, including any warranty of merchantability, satisfactory quality, or fitness for a particular purpose; however Alloo shall make efforts to provide its services with least disruptions. However, Alloo cannot guarantee that the Alloo Services will always function without interruption, impediment or other limitations.

12. VERIFICATION

12.1 Alloo reserves the right to block the services with immediate effect, of the users who have not added a valid email id (or on which mail bounces) in their profile. Services shall be resumed only after a valid email id is provided and after it is verified.

12.2. Alloo reserves the right to verify the credentials of a user who has made a payment either through credit/debit card or Paypal or CashU with the sole aim to avoid any fraud payments. The required documents for the verification of the afore-mentioned purpose includes identity documents like Driving License issued by home country/Passport/Social Security Card/National Identity Document or any such relevant document applicable in the country in which the document was issued. Alloo takes complete authority of cancelling the transfer of credit in the Alloo account of the user who does not submit any one out of the documents mentioned above.

12.3 Alloo also reserves the right to demand a signed copy of the credit/debit card to be sent by email/Whatsapp, for the purpose of verification of the authenticity of the payer. Alloo does not store any card details and customers will be encouraged to blank out CVV details/ Security code to protect the card being misused. Alloo will hold no responsibility and is neither liable to pay for any complaint received by the card holder for any fraud transaction.

13. FAIR USAGE POLICY

All our ‘Calling Packages’ are subject to the Fair usage policy as described below. The packages have been designed for individual usage where users use the same to call their friends and family. Usage restrictions like number of unique phone numbers that can be called may be mentioned along with the package details. Even if they are not mentioned, the maximum unique numbers that a package user can call in the billing period will be limited to 20 phone numbers. This is done to ensure that usage is limited to personal reasons and not used for any commercial/tele-calling/services calling operations, where calling facility is given to multiple people by one package user.

Outcall packages are only meant for individual usage and are not for use in commercial or semi – commercial purposes. All users who purchase the outcall packages are bound by a fair usage policy guidelines, which can be revised from time to time.

Family Sharing in Alloo is meant for sharing Alloo app credit and Outcall Packages with other Alloo app users. Alloo does not hold any responsibility for the amount of credit/minutes spent via Family Sharing.

14. REFUND POLICY

Payment once made will not be refunded, so please check carefully before making the payment.

15. BILLING

You will be billed for usages rounded to the next minute: - e.g. If a call happens for 30 seconds you will be billed for 1 minute. If duration exceeds by 60 seconds, then it will be charged for 2 minutes. For example, if you make a call that lasts for 1 minute 1 second, then the call is rounded to 2 minutes.
